This is an action brought by the plaintiff against the defendant insurance company upon a policy of insurance issued on the 3d day of March, 1926, upon the life of Gordon A. Taylor, his mother Clara M: Taylor, the plaintiff, being named as the beneficiary therein.
The case was submitted to the court without a jury upon a stipulated statement of facts which is hereby referred to and made a part of this decision the same as if it were recited in full.
