MEMORANDUM OPINION STRIKING DEFENDANT’S NOTICE OF REMOVAL

I. ISSUE.

The issue for resolution is whether a party to a civil action between nondebtors in the United States District Court has the right to remove the action to a bankruptcy court with nonexclusive jurisdiction under 28 U.S.C. § 1334(b). There is a split of authority whether such a removal may be effected pursuant to 28 U.S.C. § 1452(a). Because the court concludes that this issue should be resolved by applying referral principles rather than removal principles, the court finds that a party may not…
