I concur in all the rulings of the court except the one embraced in the fourth headnote and in the corresponding division of the opinion. Prom this ruling and the judgment granting a new trial I dissent. That ruling is based upon the assignment of error contained in the eighth ground of the defendant’s motion for new trial.
