The petition in this case was filed in the Court of Common Pleas and labeled “petition by fiduciary for instructions, for construction of will and for determination of rights of parties.” It was brought by the plaintiff, the Bank — Trustee under the will of Annie Arms Bonnell, and *63named as defendants Barbara Arms Bonnell Musto, Henry Stambaugh Bonnell, and Mary Ellen Bonnell.
