NEELY, Justice:

This is an appeal from a final judgment order entered in the Circuit Court of Kana-wha County after a jury found our appellants, Mr. William Stuckey and the Witcher Creek Coal Company, liable to the appellee for damages of $100,000. We affirm the jury’s verdict.

The appellee in this case, Carl Edward Thompson, was hired by one appellant, William Stuckey, to prepare a plot of land located on Witcher Creek in Kanawha County, West Virginia, as a mine site for the other appellant, Witcher Creek Coal Company.
