— “The plaintiff complains of the defendant *386and says, that the plaintiff is a corporation duly organized under the laws of said State, and'has been for more than ■six years last past the owner of a large amount of property liable to taxation in said county. The defendant the Board of Commissioners of said county, at their June session, A. D. 1870, appropriated sixty thousand dollars to aid in the construction through said county of what was then and still is, known as the Lafayette, Muncie & Bloomington Railroad, claimed to be owned and in process of construction through said county…
