DEADY, District Judge.

On November 24. 1S77, an information was filed in this court by the district attorney against Levi AY. Nelson, charging him with cutting and removing from the lands of the United States, to wit, a certain described portion of township S) south, range 39 east, in the district of Oregon, five hundred pine trees, of the value of one hundred and twenty-five dollars, for his own private advantage and profit, contrary to section 2461 of the Revised Statutes.
