Timothy Dwayne Curtis was tried by a jury and convicted of armed robbery (OCGA § 16-8-41 (a)), aggravated assault with a deadly weapon (OCGA § 16-5-21 (b) (2)), aggravated assault with intent to rob (OCGA § 16-5-21 (b) (1)), and cruelty to animals (OCGA § 16-12-4 (b) (1)). He appeals the trial court’s denial of his motion for new trial, contending that his trial counsel was ineffective in numerous respects and that the trial court erred during sentencing by failing to merge one of the aggravated assault counts with the armed robbery count.
