Plaintiff instituted this suit against S. W. Hughes and Stanford C. Stiles in ‘his capacity as United States Marshal for the Eastern District of Texas, seeking to enjoin the defendants from selling the lands described in plaintiff’s complaint under an execution, issued by the Clerk of this court on October 24, 1950, on a judgment that was entered in Cause No. 1102 at Law on January 7, 1935, in this division of this court for the sum of $629.75 in favor of Grover C.
