Petitioner, Frankie Lee Underwood, currently an inmate at the Attica Correctional Facility, petitions for habeas corpus relief under 28 U.S.C. § 22541 Petitioner was sentenced to two concurrent terms of imprisonment of 11 to 22 years on April 15, 1983, following a jury trial during which he was found guilty of robbery in the first degree (NYPL § 160.15), and criminal possession of stolen property in the third degree (NYPL § 165.40).
