delivered the opinion of the court.

This appeal is from a judgment entered on a jury verdict in favor of the plaintiff. The action was brought to recover for personal injuries sustained by plaintiff when he tripped and fell over a bench in the physical therapy room in the building of the defendant, Springfield Lodge No. 158, Benevolent and Protective Order of Elks, known as the Elks Cluh.

The record discloses that at the time he was injured, plaintiff had been a member of defendant lodge for 16 or 17 years; that at about 4 o’clock P. M. on March 31,1956, he entered the Club and…
