MOTION TO DISMISS

The plaintiff-appellee, William F. Foster, d/b/a Lake Charles Neurosurgical Associates, moves to dismiss the appeal of defendant-appellant, William H. Lambert, as not being timely perfected.

Default judgment was rendered against the appellant on 4 March 1982. Appellant timely made application for new trial and after argument thereon, the trial court took the matter under advisement.
