Desiring to be designated a depositary for money coming into the hands of the treasurer of Powell county, the First State Bank of Ovando executed and delivered to M. F. Hayes, the treasurer, a bond in the sum of $40,000, as required by an order of the county commissioners. The plaintiffs and two others signed the bond as sureties. It was filed with the treasurer on March 7, 1921, and thereafter the treasurer deposited large sums of money with the bank.
