Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered September 13, 1978, convicting him of manslaughter in the first degree and criminal possession of a weapon in the third degree, upon a jury verdict, and imposing sentence. The appeal brings up for review the denial of defendant’s motion to dismiss the indictment on the ground he was not afforded an opportunity to appear before the Grand Jury.
