Dismissing motion.

On the trial of a case in the Bell circuit court in which Chester Clouse was the plaintiff and Glass Milling Company was the defendant, the jury returned a verdict for the defendant and a judgment was entered dismissing the plaintiff’s petition. On January 25, 1941, plaintiff’s motion for a new trial was overruled, and he prayed and was granted an appeal.
