MEMORANDUM OPINION

FACCIOLA, United States Magistrate Judge.

I herein resolve Defendant’s Motion for Summary Judgment (“Defs Mot.”). For the reasons set forth below, defendant’s motion will be denied.

BACKGROUND

Plaintiff, Theodore R. Lucas (“Lucas”), currently works for the United States Department of Education (“DOE”).
