Appeal from the Circuit Court of Marshall county; the Hon. Samuel L. Richmond, Judge, presiding. This was an action of assumpsit, brought to the January term, 1864, of the court below, by Washington E. Cook, against the Board of Supervisors of Marshall county, for the recovery of the interest due by a coupon attached to a bond issued by the defendants upon their subscription to the capital stock of a railroad company.

This was an action of assumpsit, brought for the recovery of the interest due by a coupon attached to a bond issued by the Board of Supervisors of Marshall county in payment of subscription to the capital stock of a railroad company. As a defence, the county interposed a plea that on the 28th day of February, 1853, the County Court ordered an election to ascertain whether the county should subscribe one hundred thousand dollars to the capital stock of the Western Air Line Railroad Company.
