MEMORANDUM OPINION

OSTEEN, District Judge.

Plaintiff Victoria Howard, acting pro se, brought this action in Durham County District Court on September 25, 2001. Plaintiff seeks damages and injunctive relief from Food Lion, Inc., several of its executives and managers, and an appeals referee for the Employment Security Commission of North Carolina under 42 U.S.C. § 1983; 42 U.S.C. § 1985; the Federal Tort Claims Act, 28 U.S.C. § 2671 et seq.; and the Labor Management Reporting and Disclosure Act, 29 U.S.C. § 401 et seq.
