McCulloch, C. J., Appellant was indicted.for the crime of murder in the first degree, committed by shooting and lrilling Cody Franklin,- and, on the trial of the cause, the jury returned a verdict of conviction of murder in the first degree, and fixed the punishment at life imprisonment.
The.killing of Franklin by appellant was admitted, but he attempted to justify the killing on the grounds of necessary self-defense.
