This appeal is from a judgment foreclosing a mortgage executed by the defendants to the plaintiff.

On June 15, 1923, when the contract between the parties of which the mortgage was a part was entered into, the plaintiff was, and ever since has been, a building and loan association organized under the provisions of sections 6355 to 6374, Revised Codes 1921. Section 6355 then provided, in part, that “a corporation for the purpose of raising money to be loaned among its members shall be known in this act as a ‘building and loan association.’ ” Section 6358 provided, in part, that “such…
