OPINION OF THE COURT

Ellerin, J.

We take the opportunity in this case involving the application of “Kendra’s Law” to explore the parameters of that statute.

Appellant is a 24-year-old man who was sent to the Mid-Hudson Psychiatric Center following a CPL article 730 finding that he was incompetent to stand trial on felony charges related to striking his father in the eye with a bottle. He was later transferred, on a voluntary basis, pursuant to Mental Hygiene Law § 9.13, to petitioner Manhattan Psychiatric Center (the hospital).
