I would deny the petition for writ of mandamus and/or prohibition.

“[T]he writ of mandamus is an extraordinary remedy, to be reserved for extraordinary situations ... [and] only ‘exceptional circumstances amounting to a judicial “usurpation of power” ’ will justify issuance of the writ.” Gulfstream Aerospace Corp. v.
