Action in the district court for Becker county by the administratrix of the estate of Leroy W. Moores, deceased, against defendant company and George Lavoy, to recover $5,000 for the death of her intestate. The answer alleged that the death was caused by the carelessness of plaintiff’s intestate or by the risks incident to his employment. The case was tried before Taylor, J., and a jury which returned a verdict in favor of plaintiff for $3,000. Action to recover damages for the death of plaintiff’s intestate, alleged to have been caused by the defendant’s negligence while he was in its service as a brakeman on a freight train. Verdict' for $3,000, and the defendant appealed from an order of the district court of the county of Becker denying its motion for judgment or a new trial.
