*260 {¶ 1} Appellant, John W. Sanford, appeals the Tenth District Court of Appeals' dismissal of his petition for a writ of mandamus. We affirm.

Background

{¶ 2} Sanford's complaint sets forth the following facts, which, for purposes of the motion to dismiss, the court of appeals was required to accept as true. In June 1992, Sanford was convicted of murder in Wood County, Ohio. State v. Sanford , Wood C.P. No. 91-CR-238 (June 5, 1992).
