This matter is before the Court on the objection of Beal Bank/LLP Mortgage, Ltd., to the Debtor’s claimed homestead exemption.

On October 24, 2002, Debtor Rita Marie Murphy filed a voluntary chapter 7 bankruptcy petition. On Schedule A of the petition, the Debtor claimed as exempt residential real property located in Bert-hold, North Dakota. Beal Bank objected to the claimed homestead exemption, asserting that under section 47-18-01 of the North Dakota Century Code, a debtor must reside upon the premises in order to claim a homestead…
