This matter is before the Court on the Defendant’s Motion for a Preliminary Injunction pursuant to FRCP 65. The Plaintiffs, Linton Wells and Linton Wells, II are stockbrokers formerly employed by the Defendant, Merrill Lynch, Pierce, Fenner & Smith, Inc. (“Merrill Lynch”), a brokerage firm with an office in Ashland, Kentucky.
