Martin Dahmer, Jr., Administrator of the estate of Martin Van Burén Dahmer, deceased, instituted in the Circuit Court of Greenbrier County this action of trespass on the case against The State Fair of West Virginia, a corporation, hereinafter sometimes referred to as “State Fair”, to recover damages of ten thousand dollars for decedent’s death allegedly occasioned by State Fair’s negligent failure to provide decedent with a reasonably safe place in which to work.
