BERRY, Judge.
The appellant was convicted in the district court of El Paso county for the offense of murder and his punishment assessed at confinement in the penitentiary for a term of five years. •
The testimony for the State in this case shows that the appellant and deceased had some differences over a Mexcian woman and that the deceased had made threats against the life of the appellant; they met at a church on the day of the homicide, the deceased being in a wagon with his brother and his brother’s wife and children.
