This is a child custody case. The father brought a habeas corpus proceeding in the Superior Court of Murray County contending that he had been awarded custody of the child by virtue of an agreement entered into between him and the defendant mother which had been recognized by the General Court of Justice, District Court Division of Cherokee County, North Carolina, wherein he had been granted an absolute divorce from the defendant.
