Appeal from an order of the Supreme Court, Oneida County (Anthony F. Shaheen, J.), entered October 7, 2005 in a breach of contract action. The order, among other things, denied defendant’s motion for summary judgment dismissing the complaint.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.

Memorandum: Plaintiff commenced this breach of contract action to recover damages arising from defendant’s alleged failure to pay plaintiff monies due for profit sharing and salary increases pursuant to an alleged oral agreement of employment.…
