Esquire Carpet Mills, Inc. and Al Couch d/b/a Esquire Carpet Mills (collectively Esquire) instituted suit against Kennesaw Transportation, Inc. (Kennesaw) and its president and sole shareholder, seeking damages for losses incurred when Kennesaw claimed a lien for unpaid freight charges and retained possession of a shipment of Esquire’s carpet which had been loaded onto Kennesaw’s truck in Georgia for delivery to Esquire’s customers in the western United States.
