I. INTRODUCTION

This case is before the court on Third-Party Defendant Jenkins Brick Company’s Motion to Strike, or in the Alternative, Motion to Dismiss, or in the Alternative, Motion for Judgment on the Pleadings as to Third Party Complaint and Amendment to Third-Party Complaint (File Doc. 32), filed on June 16, 1999.
