In an action by an employee of Sterling Foundations, Inc., the general contractor of a construction project, to recover damages for personal injuries against inter alla, the City of New York, the owner of the land on which the construction was being made, the city served a third-party complaint for judgment over against Sterling Foundations, Inc., alleging that Sterling was actively negligent and that it had agreed to indemnify the city.
