Defendant Herman Soifer moves pursuant to Local Civil Rule 3(j) for reargument of those portions of this Court’s December 6, 1989 Opinion which 1) collaterally es-topped Soifer from contesting the bankruptcy court’s determination of bankruptcy fraud and 2) treated depositions taken in an earlier action against Braten Apparel Corporation (“BAC”) and Daniel Rhoades as if originally taken in this action against Soi-fer.
