This was a suit in assumpsit upon a promissory note, containing a special count upon the note and also the common counts for money had and received. A jury was waived and the ease heard by the court upon a plea of general issue. The issues were found for appellee and judgment entered against appellant for $906.25. The special count set forth that the note was executed by Ben A. Gundlach for the sum of $2,240, with interest at the rate of five per cent, per annum from date, was made payable to the order of appellee and was indorsed by appellant under the name and style of B.
