These were suits in equity, brought, respectively, by the Westerly Waterworks and the Seamen’s Friend Society and others, to enjoin the town of Westerly, R. I., and others, from constructing a system of waterworks. The cases were heard together, on motions for preliminar injunctions.

These two bills in equity have been heard together on motions for a preliminary injunction. The bill and'the other proofs, taken together, show the following facts:
On the 29th day of June, 1885, the town council of Westerly voted *182to accept the proposition of James M. Pendleton and others to grant to them and to their successor, the corporation which they proposed to organize, “the right to use the public highways and public grounds of this town” for the purpose of laying water pipes, and supplying the inhabitants and the town with water, “the same to be freely and…
