Statement of the Case.

NICHOLLS, J.

In the application for this writ of review the petitioner alleged: 'That he brought his action to recover $1,-571.69, and interest, for damages resulting from defendant’s breach of contract to sell 1,000 long tons of prime cotton seed cake.

That the defendant answered by a general •denial, and pleaded the prescription of 10 and 20 days, and of 1 and 2 years. That' the case went to trial, and there was judgment for plaintiff for $1,167.44, and interest, and a nonsuit as to the remainder of plaintiff’s demand.
