The plaintiff has filed a,motion to confirm an arbitration award against the defendant Holyoke Mutual Insurance Company (hereafter, “Holyoke Mutual”). The plaintiff was injured on November 4, 1996, while operating a motor vehicle that was rear-ended by a motor vehicle operated by the defendant, Paula Seaver. The plaintiff reached a settlement with defendant Seaver’s insurance company and obtained the policy limits of the coverage available to her.
