acting as Chief Justice:
This is a suit brought by the libellants, Charles W. Scudder & Co. of Boston, Massachusetts, against the respondent, who is master of the American whaleship “ Delta,” upon a bill of exchange for $1,292 49, drawn by the respondent, at Honolulu, on the lüth day of March, 1855, for supplies furnished to the “Delta,” by A. J. Cartwright, to whom the said bill of exchange was delivered by the respondent, and by whom it was transferred to the libellants before it became due.
