This is an original proceeding brought in this court by Hart Construction Company and its insurance carrier to review an award made by a trial commissioner awarding compensation to respondent, Harry H. Weaver. The trial commissioner found that on July 3, 1947, respondent, while in the employ of Hart Construction Company, sustained an accidental personal injury arising out of and in the course of his employment consisting of an injury to his back; that as a result of such injury he sustained a permanent partial disability of 20 per cent to his body as a whole and awarded compensation.
