This was a bill brought in 1883, by DeYaughn against Minor, surviving partner of Drumright & Minor, and the executors of Drumright, praying an injunction against the rebuilding of a mill-dam across Beaver creek, which *811had then recently been washed away, and for the recovery of damages alleged to have been sustained by the complainant, growing out of the flooding of a portion of his land by the defendant’s mill-pond.
