On October 12,1971, while serving a sentence in the State of New Jersey, the appellee was indicted by the Bucks County (Pennsylvania) Grand Jury on a charge of possession of 0.2 gram of marijuana. On April 27, 1973, pursuant to the Interstate Agreement on Detainers, 1 which requires that a defendant, upon request, be brought to trial within 180 days, the appellee filed a request for disposition of that indictment. 2 On April 30, 1974, the lower court granted appellee’s motion to dismiss the indictment for failure to comply with the time proscriptions of the aforesaid Act.…
