Appeal by the defendant, Catherine Haverty, as administratrix, etc., from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 25th day of November, 1912, upon the verdict of a jury rendered by direction of the court, and also from, an order entered in said clerk’s office on the 24th day of December, 1912, denying the defendant’s motion for a new trial made upon the minutes.

The plaintiff leased to the defendant’s intestate, at an annual rental of $2,600, a building in the city of Hew York for a term of three years commencing May 1, 1906, but in September, 1907, the term was extended so as to end May 1, 1912. The lease was in writing and contained covenants that the tenant would “comply with all the requirements of the Board of Health, Municipal Authorities and Police and Fire Departments of the City of Hew York,” and at the expiration of the term he would “quit and surrender the premises hereby demised in as good state and condition as reasonable…
