These cases were referred to Trial Commissioner James F. Davis with directions to make findings of fact and recommendation for conclusions of law under the order of reference and Rule 134(h). The commissioner has done so in an opinion and report filed on February 19, 1971. No exceptions to the commissioner’s findings, opinion and recommended conclusion of law have been filed by the parties and the time for so filing under the Rules of the court and an extension of time granted to plaintiffs for such purpose has expired.
