Greene, J.:

The plaintiff and defendant were wife and husband. They separated and the plaintiff took up her residence in El Paso county, Colorado, where she brought suit for divorce, alimony, custody of their children, and attorney’s fees. While this action was pending, plaintiff commenced an action in Mitchell county, Kansas, for alimony. She then authorized, in writing, her Colorado attorneys, Messrs Crowell & *30McParlin, to make settlement of such litigations. The authority was as follows :
