MONTEITH, Chief Justice.

This action was brought in the County Court at Law of Harris County by appellant, E. N. Higgins, as beneficiary under an automobile collision policy issued by ap-pellee, Standard Lloyds, to recover damages to his automobile caused by an accidental collision with another automobile. Appellee, Mossier Acceptance Company, was made a party defendant under allegations that it was making some claim to the proceeds of said policy.
