Muller, plaintiff, contracted, on March 1, 1924, with the Kirschbaum Company, defendant, to conduct a cafe teria in its factory for one year. This arrangement was entered into so that the employees of defendant conld secure necessary refreshments on the premises. His compensation was obtained from the profits earned, which averaged $40 a week, until the occurrence of the accident which gave rise to this litigation.
