McDonald, judge.

This is an appeal from an order revoking probation.

On April 1, 1959, upon his plea of guilty, appellant was convicted of the offense of burglary, and his punishment assessed at confinement in the penitentiary for a term of three years. The imposition of sentence was suspended and appellant was placed upon probation.

On February 15, 1961, the district attorney filed an application to revoke the probation, alleging that appellant had violated the terms of the probation order in committing the act of burglary and that he had also failed to contribute to the support of his minor…
