This is an appeal from a judgment of the Supreme Court at Special Term, entered August 28, 1970, which dismissed petitioner’s application in a proceeding under article 78 of the CPLB to restrain the Public Employment Belations Board from prosecuting a charge of violating subdivision 1 of section 210 of the Civil Service Law.
