Hempstead County Hunting Club (HCHC) filed a citizen’s suit against Southwestern Electric Power Company (SWEPCO) pursuant to the Clean Air Act (CAA), 42 U.S.C. §§ 7401-7671, seeking a preliminary and permanent injunction to prevent SWEPCO from commencing construction, constructing, or continuing construction of its 600-megawatt pulverized coal-fired power plant in Hempstead County, Arkansas, without first obtaining a Prevention of Significant Deterioration (PSD) permit as required by the CAA. 1 On the same day that it filed its complaint, HCHC filed a motion for temporary restraining order…
